Who Is Liable in a Bus Accident in Illinois?

September 24, 2026

Key Takeaways

  • The company or public body that operated the bus is usually liable for its driver’s negligence. Another driver, a mechanic or a parts maker can share the blame.
  • Who ran the bus decides your deadline. A lawsuit against the CTA, Pace or a public school district must be filed within one year. Most claims against private bus companies get two years.
  • The CTA statute has no separate notice-of-claim step. Section 41 of the Metropolitan Transit Authority Act sets a one-year filing limit and nothing more.
  • A bus operator owes its passengers “the highest degree of care” while they board, ride and get off.
  • Pedestrians, cyclists and drivers hit by a bus are owed ordinary care, and their own share of fault reduces or bars recovery under the 51% rule.
  • Transit agencies cannot be held liable for failing to prevent a crime by another passenger. That immunity is in 70 ILCS 3615/2.08.

The short answer

In an Illinois bus accident, the party usually liable is whoever operated the bus: the Chicago Transit Authority, Pace, a school district, or a private bus company, which answers for a driver’s negligence on the job. A driver who hit the bus, a maintenance contractor, or the maker of a defective part can be liable alongside it or instead of it.

That is the easy half. Who ran the bus also decides how long you have to file, how much care you were owed, and which defenses the operator can raise. A CTA bus and a charter coach can collide at the same corner and leave the same injured passenger with two different deadlines. So the first job after any bus crash is to find out, in writing, who ran the bus.

First, find out who ran the bus

Illinois attaches a different filing deadline to each kind of operator.

Who ran the bus What it is in law Deadline to sue Statute
CTA bus Public transit authority created by the Metropolitan Transit Authority Act 1 വർഷം 70 ഐഎൽസിഎസ് 3605/41
Pace bus Suburban Bus Division, a Service Board of the Northern Illinois Transit Authority 1 year, including wrongful death 70 ILCS 3615/5.03
School bus run by the district Local public entity under the Tort Immunity Act 1 year, for the district and its employees 745 ഐഎൽസിഎസ് 10/8-101
Private company: charter, intercity, shuttle, or a contractor running school routes Private business 2 വർഷം 735 ഐ.എൽ.സി.എസ് 5/13-202
Another driver who hit the bus Private individual or business 2 വർഷം 735 ഐ.എൽ.സി.എസ് 5/13-202

Three things in that table catch people out.

The CTA deadline is one year to file suit, with no notice step. Several pages online still say you must serve a notice of claim on the CTA first, or that you get one year for notice and two for the lawsuit. The statute says neither. Section 41, as amended effective June 1, 2009, provides that no civil action for personal injury “shall be commenced in any court against the Authority” unless it is “commenced within one year from the date the cause of action accrued.” Reporting the crash to the CTA does not stop the clock.

Pace carries the same one-year limit. Pace describes itself as the Suburban Bus Division of the regional authority, which the legislature renamed the Northern Illinois Transit Authority on June 1, 2026. Section 5.03 of that Act bars any suit “against the Authority or a Service Board” for “any wrongful death or for any injury to any person” unless filed within one year. Pace, Metra and the CTA are all Service Boards.

The regional authority itself is usually the wrong defendant. The same section says the Authority “shall not be liable” for a transit agency’s acts just because it funds that agency. Sue the operator of the bus, not the body that pays for it.

Bar chart of buses involved in fatal crashes in the United States in 2022: 87 school buses, 74 transit buses, 14 intercity buses and 38 other or unknown, 213 in total

The Federal Motor Carrier Safety Administration counted 213 buses involved in fatal crashes nationally in 2022, and 161 of them were school buses or transit buses. Those are the buses most likely to be run by a public body, which is where the one-year deadlines live.

If you were a passenger: the highest degree of care

Illinois treats a bus company as a common carrier, and a common carrier owes its passengers more than ordinary care. The pattern jury instruction IPI 100.01 tells jurors that a carrier “has a duty to its passengers to use the highest degree of care consistent with the mode of conveyance used and the practical operation of its business.” The instruction traces that duty to Rotheli v. Chicago Transit Authority, 7 Ill. 2d 172 (1955), and lists buses among the vehicles courts have treated as common carriers.

It also says the carrier “is not a guarantor of its passengers’ safety.” You still have to show the operator fell short and that the failure caused your injury. The high standard matters most in the cases passengers usually have: a fall when a bus lurches away from a stop, a closing door, a hard brake with riders standing.

The protection has edges, and the pattern instructions mark them:

  • It starts when you board. IPI 100.09 covers anyone who, with the carrier’s consent, is “in the act of boarding,” is on the vehicle, or is “in the act of alighting.” You need not have paid a fare yet.
  • It lasts until you reach safety. The relationship continues after you step off until you have had “a reasonable opportunity to reach a place of safety.” After that, you are owed ordinary care.
  • Riders who need more help get more. Under IPI 100.08, when a carrier knows a passenger is disabled, infirm, intoxicated or a child traveling alone, it must give “that additional care which the circumstances reasonably require.”

The CTA also sits outside the Tort Immunity Act altogether. Section 2-101 of that Act says it does not affect liability “based on operation as a common carrier” and “does not apply to any entity organized under or subject to the Chicago Transit Authority Act.” For how the same carrier rules reach rideshare riders, see our post on common carrier law for rideshare passengers.

If a bus hit you: pedestrians, cyclists and other drivers

If you were walking, cycling or driving when a bus hit you, you were not its passenger. The bus driver owed you the ordinary care every driver owes everyone on the road. The deadline still follows the operator: one year against the CTA, Pace or a school district, two years against a private company.

Your own conduct matters more in these cases. Under 735 ILCS 5/2-1116, if your share of fault is 50% or less, your damages are reduced by that share, and if it is “more than 50%,” you recover nothing. We explain the rule in the Illinois 51% fault rule, and how it plays out for pedestrians who are partly at fault and cyclists hit by a vehicle.

If another passenger attacked you

This is where Illinois transit agencies are most protected. 70 ILCS 3615/2.08 says the regional authority, the Suburban Bus Division, the Commuter Rail Division and the Chicago Transit Authority cannot be held liable “for failure to provide a security or police force,” for “failure to provide adequate police protection or security,” or for “failure to prevent the commission of crimes by fellow passengers or other third persons.”

That immunity is aimed at crimes by other riders and outsiders. An assault by the operator’s own on-duty employee is different: IPI 100.04 says a carrier is liable for intentional harm to passengers by an employee “then on duty.” A private bus company has no statutory immunity of this kind, although a passenger suing one over another rider’s attack must still show the company knew or should have anticipated the danger, under IPI 100.03.

School buses: the district, the contractor, or both

When the district runs the bus, the district is a “local public entity” under 745 ILCS 10/1-206, which names school districts and school boards expressly. Section 8-101 then requires any civil action against the district “or any of its employees” to be filed within one year from the date the injury was received or the cause of action accrued. That covers the district’s driver as well as the district. The district can also raise the defenses the Tort Immunity Act gives public bodies, which the CTA cannot.

When a private contractor runs the bus, the contractor is a private business and the two-year limit in 735 ILCS 5/13-202 applies to it. But a family may also have a claim against the district, for example over a stop the district chose, and that claim still carries the one-year limit.

So until you know in writing who owned the bus and who employed the driver, treat the one-year date as your deadline. A yellow bus tells you nothing about which of the two you are dealing with.

Private buses: charters, intercity lines and shuttles

A charter coach, an intercity line or a private shuttle is a private business, and a suit against it must be filed “within 2 years next after the cause of action accrued” under 735 ILCS 5/13-202. A line that sells seats to the public, such as an intercity route, is a common carrier, so its passengers get the highest degree of care. Whether a charter hired by one group counts as a common carrier can be disputed, and the answer turns on the facts.

Federal rules in 49 CFR 387.33 require for-hire motor carriers of passengers operating in interstate commerce to carry at least $5,000,000 in liability coverage for vehicles seating 16 or more passengers including the driver, and $1,500,000 for vehicles seating 15 or fewer. A bus that stays within Illinois may not fall under that rule, so ask for the actual policy rather than assuming the federal minimum applies.

Who else can share the blame

  • Another driver. A bus crash can start with a car running a light or cutting in. That driver is a separate claim on the ordinary two-year clock, which our post on the Illinois car accident statute of limitations explains.
  • A maintenance contractor, if brakes, doors or tires were serviced by someone other than the operator.
  • A manufacturer, if a defective part caused the crash. That is a product liability claim with its own rules.

Serious cases often turn on getting every responsible party into the case before the earliest deadline passes, which for a transit or school bus crash is one year.

What to do in the first weeks

  • Write down the bus number, route and time. A transit bus usually shows its number on the front.
  • Find out who owned the bus and who employed the driver, in writing, especially for a school bus or a shuttle.
  • Put the one-year date in your calendar if a public body might be involved, even while you are still finding out.
  • Report the crash to the operator and the police, and keep the report numbers. A report does not extend any deadline.
  • Ask a lawyer to request video early. Buses, stops and nearby businesses often have cameras, and footage is not kept forever.
  • Get medical care and keep the records, even if the injury feels minor.

Injured on or by a bus in Illinois?

An injury suit against the CTA, Pace or a public school district must be filed within one year, and reporting the crash does not stop that clock.

Who is liable in a bus accident?

Usually the operator of the bus, meaning the CTA, Pace, a school district or a private bus company, which is responsible for its driver’s negligence on the job. Another driver, a maintenance contractor or a parts manufacturer can also be liable. Which operator ran the bus decides whether you have one year or two to file suit.

Can you sue the CTA after a bus accident?

Yes. The CTA owes its passengers the highest degree of care as a common carrier, and the Tort Immunity Act does not apply to it. The main limits are the one-year filing deadline in 70 ILCS 3605/41 and a statutory immunity for failing to prevent crimes by other passengers.

How long do you have to sue the CTA in Illinois?

One year from the date the cause of action accrued, under Section 41 of the Metropolitan Transit Authority Act. The statute has no separate notice-of-claim step, so reporting the accident to the CTA does not extend the deadline. The lawsuit itself must be filed within the year.

Can a bus driver be sued?

A driver can be named, but the claim that matters is usually against the operator, which answers for a driver acting on the job. For a school district driver, the one-year limit in 745 ILCS 10/8-101 applies to the employee as well as the district.

What if I fell on a bus that did not crash?

You can still have a claim. The highest degree of care applies while you board, ride and get off, so a fall caused by a sudden lurch or a closing door is judged against that standard. The operator is not a guarantor, though, so you must show it fell short and that the failure caused your injury.

How much compensation can you get for a bus accident?

There is no standard figure. Compensation depends on your medical bills, lost income, pain and suffering and the long-term effect of the injury, reduced by any share of fault assigned to you. If you are found more than 50% at fault, you recover nothing under 735 ILCS 5/2-1116.

Talk to an Illinois bus accident lawyer

The first question in a bus case is not how the crash happened. It is who ran the bus, because that decides whether you have one year or two.

Lawyer Furqan handles bus accident claims against the CTA, Pace, school districts and private bus companies, for passengers, pedestrians and drivers across Cook County, including Oak Lawn, Orland Park, Skokie and the surrounding suburbs. If a bus crash took a family member, see who can file a wrongful death lawsuit in Illinois.
