Two separate routes exist after a hit-and-run, and it is worth holding both in mind from the start.

If the driver is identified, you have an ordinary negligence claim against them, and leaving the scene tends to hurt their position rather than help it. If the driver is never identified, Illinois law requires your own policy to respond.

What the driver was legally required to do

Under 625 ILCS 5/11-401, a driver involved in a crash causing injury or death must stop at the scene, or as close as possible, and remain until the requirements of Section 11-403 have been satisfied.

625 ILCS 5/11-403 then requires them to give their name, address, registration number and the owner of the vehicle, exhibit their driver’s license on request where available, and render reasonable assistance — including arranging transport for treatment where that is apparently necessary or is requested by the injured person.

A rider left on the road while a driver leaves is therefore facing a breach of two obligations at once, quite apart from the negligence that caused the collision.

The coverage that answers when nobody is found

This is the part that decides most hit-and-run rider cases.

215 ILCS 5/143a is titled “Uninsured and hit-and-run motor vehicle coverage,” and it requires Illinois policies to include coverage for persons insured who are legally entitled to recover damages from the owners or operators of uninsured and hit-and-run motor vehicles, because of bodily injury, sickness or disease, including death.

Note what that covers, because it matters. The coverage is for bodily injury. An injured rider is squarely within it. Damage to the motorcycle itself is a property loss and is a matter for your own collision cover instead, a distinction we set out in parked car accident claims.

How much cover you have

Probably more than you think. Under 215 ILCS 5/143a-2(1), uninsured motorist coverage must be included equal to your own bodily injury liability limits, unless you specifically rejected the excess in writing. A rejection under 143a-2(2) must be written and binds everyone insured under the policy.

Two limits on that:

  • No stacking. Under 143a, limits on one vehicle may not be aggregated with similar coverage on your other vehicles for one person in one crash.
  • Arbitration, not litigation. Policies must provide that disputes about coverage and the amount of damages go to the American Arbitration Association, with separate provision for medical opinions.

Finding the driver

Identification is usually an evidence race rather than an investigation, because everything useful expires:

Do not let your motorcycle be repaired or disposed of before it has been examined and photographed. It carries the paint and impact evidence, and once it is gone that evidence cannot be recreated.

Report it, and report it promptly

Under 625 ILCS 5/11-407(a) immediate notice to police is required where a crash causes injury or death, property damage over $1,500, or damage over $500 where a vehicle subject to Section 7-601 is uninsured. Beyond the legal duty, insurers generally require a police report before an uninsured or hit-and-run claim will be entertained, so prompt reporting protects the coverage as well.

Note that the driver’s own written 10-day crash report was repealed by Public Act 102-560, effective 20 August 2021. The surviving 10-day period is the investigating officer’s under 625 ILCS 5/11-408.

Deadlines

Two years for injury under 735 ILCS 5/13-202. One year where a local public entity or its employee is a defendant under 745 ILCS 10/8-101(a), and one year for personal injury actions against the Chicago Transit Authority under 70 ILCS 3605/41.
